UNAUTHORIZED USE OF PLANS WITH UNLIMITED SERVICES

Canelophone.com with services provided by Liberty Mobile Wireless LCC offer certain Plans with unlimited services (i.e., voice, text, or data) that are to be used for the following purposes: (a) person to person voice calls, (b) text and picture messaging, and (c) web browsing, email, ordinary content downloads and uploads, video and audio streaming without excessively contributing to network congestion.

Canelophone.com plans may not be used for certain unauthorized uses that adversely impact our service to other customers or the Carrier’s network. Examples of some unauthorized uses include, but are not limited to, the following: (i) continuous uninterrupted voice calls; (ii) automated text or picture messaging to another mobile device or e-mail address or texts made to more than 50 different numbers in a day; (iii) uninterrupted and continuous uploading, downloading, or streaming of audio or video; (iv) server devices or host computer applications, including, but not limited to, web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections or peer-to-peer ("P2P") file sharing; (v) as a substitute or backup for private lines or dedicated data connections; (vi) access to the internet, intranets, or other data networks except as the device’s native applications and capabilities permit (excluding all hotspot applications), (vii) tethering your phone to a laptop or personal computer other than for the use of wireless sync, or (viii) any applications that allow your phone to act as an internet access point or Wi-Fi for other devices and computers. A customer engaged in any unauthorized use may have their service suspended and/or terminated at Canelophone.com’s sole discretion

Unlimited voice services may not be used for monitoring services, data transmission, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing activity, autodialed calls, or robocalls. Canelophone.com reserves the right to cancel or deactivate Service or reduce data throughput speeds in order to protect the Carrier’s network from harm due to any cause including, without limitation, the excessive and/or unauthorized use of Canelophone.com Service. Canelophone.com reserves the right to limit throughput or amount of data transferred and to deny or terminate Service to anyone Canelophone.com believes is using their Service in an unauthorized manner or whose usage, in Canelophone.com’s sole discretion, adversely impacts a Carrier’s network or customer service levels. Canelophone.com will presume you are engaging in an unauthorized use in violation of these Terms and Conditions, if in Canelophone.com’s sole discretion, you are placing an abnormally high number of calls, or repeatedly placing calls of unusually long duration, if your minutes are deemed excessive by Canelophone.com during a 30-day period, or if your talk, text or data usage is harmful or disruptive to the Carrier’s network or service levels. If we determine, in our sole discretion, that you are using your service in violation of the Canelophone.com Terms and Conditions or in any other manner that we deem to be unreasonable or excessive, we may terminate individual calls or data connections, terminate or reduce data throughput or terminate your service, decline to renew your service, or offer you a different prepaid plan with no unlimited usage component.

Canelophone.com may discontinue providing service to you, terminate your account, terminate data connections and/or reduce data throughput speeds for customers whose usage, in the sole judgment of Canelophone.com: (a) appear likely to generate abnormally high call volumes or data usage and/or abnormally long or short average call lengths or data usage as compared to the usage of other Canelophone.com customers or (b) may be harmful, disruptive, or interfere with the Carrier’s network, Canelophone.com’s service or the ability to provide quality service to other customers. By initiating Service and placing or receiving calls, you acknowledge and agree to Canelophone.com’s right to terminate your Service under these circumstances. Canelophone.com may discontinue providing service to you, terminate your account, terminate data connections and/or reduce data throughput speeds for customers whose usage, in the sole judgment of Canelophone.com: (a) appear likely to generate abnormally high call volumes or data usage and/or abnormally long average call lengths or data usage as compared to the usage of other Canelophone.com or Liberty Mobile Wirelss LLC customers or (b) may be harmful, disruptive, or interfere with the Carrier’s network, Canelophone.com, and Liberty Mobile Wirelss LLC’s service or the ability to provide quality service to other customers. By initiating Service and placing or receiving calls, you acknowledge and agree to Canelophone.com and Liberty Mobile Wirelss LLC’s right to terminate your Service under these circumstances.

Plans are designed for use with a smartphone and not intended to support tablets, hot spots, routers, or other data only devices. On plans that support tethering, the tethering must originate from a smartphone. Line must be activated with the IMEI of the device that will be in use. Removing a SIM from the device that was activated and placing it in an ineligible device is prohibited and may lead to the line being disconnected. Data speeds will slow when the threshold has been met, however if a plan change is made during a bill cycle the threshold may be reset resulting in more data usage than defined by the plan. It is encouraged that plan changes are made at the beginning of the next bill cycle to avoid excessive usage above the tier threshold.

Los Planes de Canelophone.com con servicios ilimitados (ej., texto de voz, texto o datos) sólo pueden ser usados para los siguientes propósitos: (a) llamadas de voz persona a persona, (b) textos y mensajes con imágenes, y (c) navegación en la web, correo electrónico, descargas y cargas de contenido ordinario, transmisión de video y audio sin contribuir de manera excesiva a la congestión en la red.

Los Planes de Canelophone.com no pueden ser usados para ciertos usos no autorizados que impacten nuestro servicio de manera adversa, a otros clientes o a la red del Operador. Algunos ejemplos de uso no autorizado incluyen, pero no se limitan a: (i) llamadas de voz continuas sin interrupción; (ii) texto automatizado o mensajes de imágenes a otro dispositivo móvil o dirección de correo electrónico; (iii) cargas o descargas no interrumpidas y continuas, o la transmisión de audio o video; (iv) dispositivos de servidores o aplicaciones en un computador ajeno, incluyendo pero no limitado a, publicaciones de cámaras web o transmisiones, alimentación de datos automatizados, o conexiones máquina a máquina o entre pares ("P2P") compartir archivos; (v) como un sustituto o un respaldo para líneas privadas o conexiones de datos dedicados; (vi) acceso al internet, intranets u otras redes de datos excepto como la aplicación original del dispositivo y las capacidades permitan (excluyendo todas las aplicaciones de puntos calientes), (vii) atando su teléfono a su computador portátil o computador personal aparte del uso de sincronización inalámbrica, o (viii) cualquier aplicación que permite su teléfono en actuar como un punto de acceso al internet o Wi-Fi para otros dispositivos y computadores. Un cliente que se involucre con algún uso que no sea autorizado puede tener su servicio suspendido y/o terminado a la discreción única de Canelophone.com.

Canelophone.com se reserva el derecho en cancelar o desactivar el Servicio, o en reducir los datos en velocidades de rendimiento para proteger la red del Operador de daños debidos a cualquier causa incluyendo y sin límite al uso excesivo y/o no autorizado del Servicio Canelophone.com. Canelophone.com supondrá que usted se encuentra participando en un uso no autorizado en violación de estos Términos y Condiciones, si a la única discreción de Canelophone.com usted está haciendo un número de llamadas anormalmente altas, o hace llamadas repetidamente de una duración inusualmente largas, sí sus minutos se consideran excesivos por Canelophone.com durante un periodo de 30-días, o si sus conversaciones, texto y uso es dañino o perjudicial a la red del Operador o a los niveles de servicio. Sí determinamos a nuestra única discreción, que usted está usando su servicio en violación de los Términos y Condiciones de Canelophone.com, o de cualquier otra manera que consideremos en ser irrazonable o excesivo, podremos terminar llamadas individuales o conexiones de datos, terminar o reducir las velocidades en rendimiento o terminar su servicio, rehusar en renovar su servicio, u ofrecerle un plan pre pagado diferente sin el componente de uso ilimitado.

Canelophone.com puede descontinuar en proveerle servicio, terminar su cuenta, terminar conexiones de datos y/o reducir las velocidades en rendimiento para los clientes cuyo uso, al único juicio de Canelophone.com: (a) aparece la probabilidad en generar anormalmente altos volúmenes de llamadas o usos de datos y/o un promedio de llamadas que son anormalmente largas, o uso de datos en comparación al uso de otros clientes de Canelophone.com, o (b) que pueden ser dañinos, perjudiciales o que interfieran con la red del Operador, los servicios de Canelophone.com, o la capacidad en proveer un servicio de calidad a otros clientes. Al iniciar el Servicio y colocar o recibir llamadas, usted reconoce y acuerda al derecho de Canelophone.com en terminar su Servicio bajo estas circunstancias.

Los planes están diseñados para su uso con un teléfono inteligente y no para admitir tabletas, puntos de acceso, enrutadores u otros dispositivos de solo datos. En los planes que admiten el tethering, el tethering debe originarse en un teléfono inteligente. La línea debe estar activada con el IMEI del dispositivo que estará en uso. Está prohibido quitar una tarjeta SIM del dispositivo que se activó y colocarla en un dispositivo no elegible y puede provocar la desconexión de la línea. Las velocidades de datos se reducirán cuando se haya alcanzado el umbral; sin embargo, si se realiza un cambio de plan durante un ciclo de facturación, el umbral puede restablecerse y generar más uso de datos del definido por el plan. Se recomienda que los cambios en el plan se realicen al comienzo del siguiente ciclo de facturación para evitar un uso excesivo por encima del umbral de nivel.
